Abstract

This work addresses the concept of neuro-rights and their challenges in protecting mental privacy and cognitive autonomy in the face of advances in neuro-technologies, such as brain-computer interfaces and brain-reading devices. The central research problem investigates how the regulation of neuro-rights can protect individuals from privacy invasions and cognitive manipulation. The concept of neuro-rights, its principles, and fundamental pillars, such as mental privacy, personal identity, and autonomy, are explored. The analysis of emerging legislation, such as the Chilean proposal, reveals the challenges and opportunities in the implementation of these rights. A bibliographic review methodology was employed to investigate existing literature and identify gaps in the regulation and protection of human rights in the face of these technologies. The work proposes a critical analysis of legislative proposals and recommendations for an international regulatory framework, aiming at the effective protection of neuro-rights and the responsible development of neuro technologies.
